Who we are

Helping you get the disability benefits you deserve

When you have an LTD (long-term disability) insurance policy, you expect that you can rely on it if and when you are unable to work due to a serious illness or injury. The financial and emotional impact when benefits are delayed or denied is understandably significant. Unfortunately, clients are often made to jump hurdles and navigate red tape, all while feeling the constant pressure to return to work. The system is complex with tight timelines and strict contractual obligations. Let our LTD lawyers help you navigate your denied disability claim whether you are located in Hamilton or elsewhere in Ontario.

Long-Term Disability Claims: Why They’re Denied and How We Help

Investigation

This is one of the most important stages in any litigation or accident benefits claim. We will work together to understand your unique circumstances and our team will gather all of the evidence necessary to establish your claim.

Preparation

Once pleadings have been filed on your behalf, we will prepare you for examinations as necessary and will attend discoveries with you to ensure that your rights are protected at all times. We will make sure that disclosure obligations are met and will thoroughly prepare your matter for trial and/or hearings.

Negotiation

Although we prepare every case as though it is headed for a trial or hearing, many litigation files are settled through mediation given the inevitable cost and delay associated with the court system. The team at Camporese Law is comprised of litigators who are skilled in the art of negotiation and prepared to mediate on your behalf.

Trial

If your matter does not resolve at mediation or at a subsequent Pre-Trial, the team at Camporese Law will have your matter trial or hearing ready. With over 35 years of experience before both judges and juries, we are confident in moving your matter forward. Our lawyers have appeared at the Ontario Court of Appeal, Ontario Superior Court of Justice, Licence Appeal Tribunal and various other administrative bodies.

Common Reasons Disability Claims Are Denied

Long-term disability benefits can be denied for many reasons. They can be denied outright, upon a change of the applicable definition (typically at the 2-year mark) or upon an alleged change in circumstances such as full or partial recovery. Insurance companies often deny claims based on non-compliance with strict policy terms or allegations of insufficient medical evidence. No matter what stage your claim is at, the team at Camporese Law will gather the evidence supporting your disability and resulting functional limitations, arrange for expert medical opinion as necessary and present this to your insurance company. We will handle any appeals on your behalf and negotiate the best result for you. Unfortunately, valid claims can still be denied in which case we will pursue the benefits in court on your behalf. We will be with you every step of the way.

Impact of Disability on Daily Life

Illnesses that may qualify for long-term disability coverage include cancer, neurological disorders, autoimmune disorders, degenerative diseases, cardiovascular conditions, respiratory conditions, cognitive impairments and psychological and mental health conditions amongst others. Injuries that may qualify for LTD benefits includes quadriplegia, paraplegia, traumatic brain injuries, spinal cord injuries, orthopaedic injuries, arthritis and more. A diagnosis alone does not entitle you to LTD benefits, rather the focus is on how your diagnosis impacts your functional abilities, particularly in the workplace. We know that a serious illness or injury impacts every aspect of daily life for your and your family. The team at Camporese Law will work with you to gather and document the severity your condition and demonstrate to your insurer how it affects your ability to work.

FAQ’s

  • What are long-term disability benefits?

Long-term disability benefits are intended to replace a portion of your income if you are unable to work due to a serious illness or injury. Typically, such benefits are offered through your employer and you may or may not contribute to the premiums. Private disability plans do exist as well.
  • How do I know if I have long-term disability benefits?

If you work for an employer who provides employee benefits, ask for a copy of the benefits booklet to see what coverage is available. If your employer has an HR department they should be able to provide you with particulars as well.
  • I can’t work but don’t have long-term disability benefits. What do I do?

If you are unable to work and do not have access to LTD benefits either privately or through your employer, you may wish to consider applying to the Ontario Disability Support Program (ODSP) or for Canada Pension Plan Disability benefits (CPPD). If you are unable to work as a result of an injury that occurred due to the negligence of someone else, like a car accident or slip and fall, you may be able to seek compensation through litigation. Contact Camporese Law for more information.
  • What if my claim is denied?

If you have applied for LTD benefits and your claim has been denied, we recommend that you reach out to us immediately. Many long-term disability plans have strict deadlines for appeals along with other time-sensitive contractual obligations. Our insurance disability claim lawyers are ready to help you.
  • Can I work part-time while on long-term disability?

Some policies do allow for part-time work as rehabilitation or for a graduated return to work. The team at Camporese Law will review your policy and ensure that you are aware of both your rights and obligations.
  • Are long-term disability benefits taxable?

Generally speaking, if you paid the premiums with after-tax dollars your LTD benefits are tax-free. If your employer contributed to any portion of the premiums however, your LTD benefits are usually taxable.
